Effective Date: August 1, 2022
These Piemob Terms of Service (“Terms”) govern your use of our Piemob website (the “Site”) and related applications, products and services, including any content or information provided as part of the Site or such related applications, products, services or websites (collectively with the Site, the “Services”), which are owned or operated by Datascape, Inc., a Georgia corporation (“Datascape”, “we”, “our” or “us”).
Our Privacy Policy, available at www.piemob.com/privacypolicy , is incorporated by reference into these Terms. Please read these Terms and the Privacy Policy carefully before you access the Services, as these Terms form a binding legal agreement between you and Datascape. By accessing, registering for or using the Services, you: (1) acknowledge that you have read and understand these Terms; (2) agree to be bound by them in their entirety, and (3) are entering into a legally binding agreement with us.
IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE THE SERVICES. YOUR USE OF OUR SERVICES REQUIRES YOUR ACCEPTANCE OF THESE TERMS AS THEY MAY BE AMENDED FROM TIME TO TIME, INCLUDING THE POLICIES INCORPORATED BY REFERENCE HEREIN, WHICH INCLUDES THE DATASCAPE PRIVACY POLICY.
1. Overview of Services; Rewards.
1.1. Overview of Services. The Services may enable you to earn certain rewards (collectively, “Rewards”) in connection with your use and participation in certain offers made available by the Services, including through your viewing and engagement with certain third-party video advertisements (“ads”), playable ads, advertising offers, or market research survey offers made available through the Services. We reserve the right to change, suspend, or cancel all or a portion of the Services, including any Rewards you may have accrued, at any time without prior notice to you.
1.2. Rewards. By viewing and engaging with advertisements presented through the Services, you may be able to earn Rewards in the form of “Slices”, subject to your compliance with these Terms and otherwise fulfilling the requirements to earn such Slices and Rewards. Slices have no cash value. After you have acquired a requisite number of Slices (as determined by Datascape in its sole discretion), you may be able to redeem a set number of Slices for corresponding Rewards, which can be applied toward making a bill payment or other use to the extent enabled by the Services. The timing of the issuance of Slices and Rewards may be determined by Datascape in its sole discretion. If you attempt to redeem Slices for a Reward and Datascape determines that the Reward is unavailable or for whatever reason cannot be provided to you, Datascape may, in its sole discretion, provide you with a Reward of equal or greater value. No credit, reversal, or refund of Slices will be issued for any reason after Slices have been redeemed. Some Rewards may have eligibility requirements; in such case, Datascape reserves the right to verify your identity (by requesting photocopy of your driver’s license, state ID card, or other documentation Datascape may require) prior to crediting Slices or fulfilling any Reward. Once you are awarded a Reward, you may not cancel the Reward or return the Reward for a refund of Slices. Slices are nontransferable, may not be traded or sold, and are void if a transfer is attempted, nor are such Slices or your account transferable upon death or otherwise by operation of law. Datascape may limit, suspend or terminate your ability to participate in its sole discretion, and may void any Slices or Rewards you may have earned or accumulated, if we determine that you have not complied with these Terms.
1.3. Expiration; Inactivity. To the extent any Slices or Rewards remain unredeemed 90 calendar days after being earned by you, such Slices and Rewards shall automatically expire and no longer be valid or available for redemption or other use. Rewards Program points are nontransferable, may not be bartered or sold, and are void if a transfer is attempted, and such points and the associated Account are not transferable upon death, as part of a domestic relations matter or otherwise by operation of law. If you do not log into your account or earn or redeem Slices for 180 calendar days or more, your account may be deemed inactive and closed without any compensation or further obligation to you. If these Terms or your use of the Services is terminated, all outstanding Slices and Rewards that have not been redeemed at such time shall automatically expire.
1.4. Taxes. You acknowledge and agree that you are solely responsible for: (a) determining whether or not the Slices or Rewards you earn or redeem are considered reportable taxable earnings in your jurisdiction, and (b) any and all tax liability arising from or associated with your use of the Services, including liability arising from your accrual and redemption of Slices and Rewards. We reserve the right to require you to provide necessary tax reporting information in our sole discretion.
